Health Monitor Terms of Service

Welcome to Health Monitor! These Terms of Service ("Terms," "Agreement") govern your access to and use of the Health Monitor mobile application ("App," "Service," "Health Monitor") available on iOS devices. By downloading, installing, accessing, or using Health Monitor, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By using Health Monitor, you acknowledge and agree that:

• You have read, understood, and agree to be bound by these Terms
• You have read and agree to our Privacy Policy, which is incorporated into these Terms by reference
• You are at least 13 years of age (or the minimum age in your jurisdiction)
• You have the legal capacity to enter into this binding agreement
• If you are between 13 and 18 years old, you have obtained parental or guardian consent to use the App
• If using the App on behalf of an organization, you have authority to bind that organization to these Terms

2. Medical Disclaimer

2.1 No Medical Advice

Health Monitor does not provide medical advice. Any insights, recommendations, or information provided by the App are for general informational and educational purposes only. They should not be considered medical advice or used as a substitute for consultation with qualified healthcare professionals.

2.2 User Responsibility

You are solely responsible for:

• Consulting with your doctor or healthcare provider before making any health decisions
• Verifying the accuracy of data you enter into the App
• Using appropriate medical devices to obtain health measurements
• Following your healthcare provider's treatment plan
• Seeking immediate medical attention for emergencies or concerning symptoms

3. Description of Service

Health Monitor provides a platform for users to:

• Blood Sugar Tracking: Record and monitor blood glucose readings
• Blood Pressure Tracking: Log systolic and diastolic blood pressure measurements
• Heart Rate Tracking: Record heart rate measurements
• Data Visualization: View trends, charts, and statistics based on your entries
• Reminders: Set up notifications for measurements and medications
• Apple Health Integration: Optional synchronization with Apple Health app
• iCloud Sync: Optional cloud synchronization across your iOS devices
• Export Reports: Generate PDF or CSV reports for sharing with healthcare providers

3.2 Service Modifications

We reserve the right to modify, suspend, or discontinue any feature or aspect of the Service at any time, with or without notice, and without liability to you.

4. User Responsibilities and Acceptable Use

4.1 Accurate Data Entry

You are responsible for:

• Entering accurate and truthful health information
• Using calibrated and approved medical devices for measurements
• Reviewing and verifying all data you input
• Updating or correcting inaccurate information promptly

4.2 Appropriate Use

You agree to use Health Monitor only for lawful, personal, non-commercial purposes. You may NOT:

• Use the App for medical diagnosis or treatment decisions without consulting healthcare professionals
• Rely solely on the App for managing critical or life-threatening health conditions
• Share your health data in violation of applicable privacy laws
• Use the App to provide medical advice or services to others
• Attempt to reverse engineer, decompile, or disassemble the App
• Remove or circumvent any security features or protections
• Use automated systems, bots, or scrapers to access the Service
• Upload malicious code, viruses, or harmful content
• Violate any applicable laws or third-party rights
• Sell, rent, lease, or redistribute the App without authorization

5. Data Accuracy and Reliability

5.1 User-Entered Data

Health Monitor relies on data that YOU enter. We cannot verify the accuracy of your entries. The App's calculations, trends, and insights are only as accurate as the data you provide.

5.2 No Guarantee of Accuracy

We do not guarantee that:

• The App will be error-free or uninterrupted
• Calculations or statistics will be completely accurate
• Data synchronization will always work perfectly
• Notifications will always be delivered on time
• The App is suitable for your specific health condition

6. Intellectual Property Rights

6.1 Our Intellectual Property

Health Monitor, including all content, features, functionality, source code, algorithms, user interface, graphics, logos, and trademarks, is owned by us and protected by international copyright, trademark, patent, and other intellectual property laws.

6.2 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your personal iOS devices
• Use the App for personal, non-commercial health tracking purposes
• Access features in accordance with these Terms

This license automatically terminates if you violate these Terms.

6.3 Your Data Ownership

You retain all rights to the health data you enter into Health Monitor. We do not claim ownership of your personal health information.

7. Privacy and Data Protection

Your use of Health Monitor is also governed by our Privacy Policy, which explains how we handle your data. Key points include:

• Your health data is stored locally on your device and in your personal iCloud account (if you enable sync)
• We do not collect, access, or store your health data on our servers
• We do not sell or share your personal health information with third parties
• You have full control over your data and can delete it at any time

8. Apple Health and iCloud

8.1 Apple Health Integration

If you choose to integrate with Apple Health:

• You grant Health Monitor permission to read and write specified health data
• Data sharing is governed by Apple's HealthKit framework and policies
• You can revoke permissions at any time in iOS Settings
• We are not responsible for Apple Health's functionality or data handling

8.2 iCloud Synchronization

If you enable iCloud sync:

• Your data will be stored in your personal iCloud account
• iCloud storage is subject to Apple's terms and your iCloud storage limits
• You are responsible for maintaining your iCloud account security
• We are not responsible for iCloud service availability or functionality

9. Disclaimers and Warranties

9.1 "AS IS" Provision

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the App will meet your specific health tracking needs
• Warranties that the App will be error-free, secure, or uninterrupted
• Warranties regarding the accuracy, reliability, or completeness of data, calculations, or insights
• Warranties that the App is suitable for managing your health condition
• Warranties that defects will be corrected or that updates will be provided

9.2 No Medical Warranty

WE MAKE NO WARRANTIES REGARDING:

• The App's suitability for medical use or health management
• The accuracy of health insights or recommendations
• The App's ability to detect health problems or abnormalities
• The reliability of data synchronization or storage

10. Limitation of Liability

10.1 Liability Limitations

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL HEALTH MONITOR, ITS AFFILIATES, DIRECTORS, EMPLOYEES, LICENSORS, OR AGENTS BE LIABLE FOR:

• Any indirect, incidental, consequential, punitive, or special damages
• Medical complications, injuries, or health deterioration
• Lost data, revenue, profits, or business opportunities
• Personal injury or wrongful death
• Failure to detect health problems or emergencies
• Reliance on inaccurate data, calculations, or insights
• Data loss or corruption
• Incompatibility with your devices or other apps
• Any damages arising from use or inability to use the App

10.2 Maximum Liability Cap

Our total liability to you for any claims arising from your use of Health Monitor shall not exceed fifty U.S. dollars ($50.00) or the amount you paid for the App in the past 12 months, whichever is greater.

10.3 Essential Basis of Agreement

You acknowledge that these limitations of liability are an essential basis of the agreement between us, and that we would not provide the App without these limitations.

11. Indemnification

You agree to indemnify, defend, and hold harmless Health Monitor, its affiliates, officers, directors, employees, licensors, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from or related to:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of applicable laws or regulations
• Health decisions made based on information from the App
• Data you enter, store, or share through the App
• Your negligent or willful misconduct

12. Third-Party Services and Content

Health Monitor may integrate with or link to third-party services (such as Apple Health, iCloud). We are not responsible for:

• The availability, accuracy, or content of third-party services
• Third-party privacy practices or terms of service
• Any harm or damages arising from third-party services
• Changes or discontinuation of third-party integrations

Your use of third-party services is governed by their respective terms and policies.

13. Updates and Modifications

13.1 App Updates

We may release updates to the App from time to time. Updates may:

• Add new features or modify existing features
• Fix bugs or improve performance
• Address security vulnerabilities
• Change the user interface or functionality

You are responsible for downloading and installing updates. We recommend keeping the App updated for optimal performance and security.

13.2 Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes:

• We will update the "Last Updated" date at the top of these Terms
• We will notify you through the App or via the App Store for material changes
• Your continued use after changes constitutes acceptance of updated Terms

If you do not agree to updated Terms, you must stop using the App and may request a refund according to Apple's App Store refund policy.

14. Termination

14.1 Termination by You

You may stop using Health Monitor at any time by:

• Uninstalling the App from your iOS device
• Deleting your data within the App settings
• Disabling iCloud sync
• Revoking Apple Health permissions

14.2 Termination by Us

We may suspend or terminate your access to the App if you:

• Violate these Terms or our policies
• Engage in fraudulent or illegal activities
• Threaten the security or integrity of the Service
• Use the App in a manner that could harm us or other users

14.3 Effect of Termination

Upon termination:

• Your license to use the App ends immediately
• You must stop using the App and delete it from your devices
• Data stored locally on your device remains yours to manage
• Data in your iCloud account remains under your control
• Sections of these Terms that by their nature should survive will continue to apply

15. Dispute Resolution and Governing Law

15.1 Informal Resolution

Before filing any legal claim, you agree to contact us at support@healthmonitor.app to attempt to resolve the dispute informally. We will work in good faith to resolve disputes within 60 days.

15.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of your jurisdiction of residence, without regard to conflict of law provisions.

15.3 Arbitration Agreement

Any dispute arising from these Terms or your use of Health Monitor shall be resolved through binding arbitration, except where prohibited by law. You and Health Monitor agree to waive the right to a jury trial or to participate in a class action.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Health Monitor regarding use of the App and supersede all prior agreements.

16.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

16.4 Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.

16.5 Force Majeure

We are not liable for any delay or failure to perform due to causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, or governmental actions.

17. Apple-Specific Terms

Because Health Monitor is distributed through the Apple App Store, you acknowledge and agree that:

• These Terms are between you and Health Monitor, not Apple
• Apple has no obligation to provide support or maintenance for the App
• Apple is not responsible for any claims relating to the App
• Apple is a third-party beneficiary of these Terms and may enforce them
• You must comply with Apple's App Store Terms of Service
• The App is licensed, not sold, to you
